The recent escalating arguments over whether there should be further congressional hearings on Benghazi are troubling. The fact that there are substantial numbers of people who feel that there is nothing more to investigate when four American lives were lost and no one has answered for this crime provides an indication of how far our sense of justice has slipped.
This should not be a partisan issue, because the implications of ignoring or prevaricating about the underlying mistakes will have far-reaching consequences. The United States has diplomatic establishments throughout the world, and if they can be attacked without consequences, it greatly diminishes our influence despite any protestations to the contrary.

WASHINGTON, D.C. – Arizona’s controversial Maricopa County Sheriff Joe Arpaio has raised nearly $4.5 million to finance a planned 2016 election campaign – but it’s not for the governorship, as some have speculated.

In an exclusive interview with WND, Arpaio explained being re-elected as sheriff is just too important, especially with the illegal immigration crisis and certain, “sensitive investigations” still in play.
“I would have had to resign the day I announced I was going to run for governor,” he said. “But I’m not about to abandon my troops. We have a number of highly sensitive investigations ongoing and we have a brand new headquarters building. I still have the Justice Department after me. So, I’m not giving this job up to someone else. I’m sticking around.”

Arpaio also told Rusty Humphries of the Washington Times recently one of those “sensitive” projects was his continued investigation into Barack Obama’s allegedly forged birth certificate.
“If I was the governor, which I turned down a couple of weeks ago because I would have to resign, I’m not going to leave this office to somebody coming in when I have sensitive investigations going, including the president’s birth certificate,” Arpaio said. “I haven’t finished that yet.

“I don’t care where [Obama] was born. That has nothing to do with it,” he continued. “I’m concerned about a forged, fraudulent government document. From Day 1 I’ve been investigating that, now we have to find out who’s behind that. I’m getting close.”

Why Are Dozens Of High Ranking Officers Being Purged From The U.S. Military?

Since Barack Obama has been in the White House, high ranking military officers have been removed from their positions at a rate that is absolutely unprecedented.  Things have gotten so bad that a number of retired generals are publicly speaking out about the “purge” of the U.S. military that they believe is taking place.  As you will see below, dozens of highly decorated military leaders have been dismissed from their positions over the past few years.  So why is this happening?  When I was growing up, my father was an officer in the U.S. Navy.  And what is going on right now is absolutely crazy – especially during a time of peace.  Is there a deliberate attempt to “reshape” the military and remove those that don’t adhere to the proper “viewpoints”?  Does someone out there feel a need to get officers that won’t “cooperate” out of the way?  Throughout world history, whatever comes next after a “military purge” is never good.  If this continues, what is the U.S. military going to look like in a few years?
Perhaps you are reading this and you think that “purge” is too strong a word for what is taking place.  Well, just consider the following quotes from some very highly decorated retired officers…
-Retired Army Major General Paul Vallely: “The White House protects their own. That’s why they stalled on the investigation into fast and furious, Benghazi and Obamacare. He’s intentionally weakening and gutting our military, Pentagon and reducing us as a superpower, and anyone in the ranks who disagrees or speaks out is being purged.”
-Retired Army Major General Patrick Brady: “There is no doubt he (Obama) is intent on emasculating the military and will fire anyone who disagrees with him.”
-Retired Army Lt. General William G. “Jerry” Boykin: “Over the past three years, it is unprecedented for the number of four-star generals to be relieved of duty, and not necessarily relieved for cause.”
-Retired Navy Captain Joseph John: “I believe there are more than 137 officers who have been forced out or given bad evaluation reports so they will never make Flag (officer), because of their failure to comply to certain views.”
According to the Blaze, one anonymous Pentagon official has said that even young officers have been told “not to talk about Obama or the politics of the White House”…

A Pentagon official who asked to remain nameless because they were not authorized to speak on the matter said even “young officers, down through the ranks have been told not to talk about Obama or the politics of the White House. They are purging everyone and if you want to keep your job — just keep your mouth shut.”

Now this trend appears to be accelerating.  We have seen a whole bunch of news stories about military officers being dismissed lately.
Almost always, a “legitimate reason” is given for the dismissal.  And without a doubt, if a military officer is actually behaving unethically, that officer should be held accountable.
However, the reality is that everyone has “skeletons in the closet”, and if you really want to get rid of someone it is usually not too hard to find a way to justify your decision.
The following are excerpts from three news stories about military officers in trouble that have come out so far in 2014…
#1 The Air Force Times: A group of former Air Force majors, forced out this summer by a noncontinuation board, plans to file a lawsuit claiming the service had no right to separate them simply to meet end-strength numbers set by Congress.
More than 10 of the 157 dismissed majors are banding together to challenge the move in court, seeking either reinstatement or early retirement pay. All 157 had been twice passed over for promotion and were within six years of retirement.
#2 Defense News: Acting US Navy Undersecretary Robert Martinage, the department’s No. 2, has resigned under pressure, sources confirmed for Defense News.
The resignation, which Martinage announced to his staff Tuesday morning, came after allegations were made of inappropriate conduct with a subordinate woman, the sources confirmed.
#3 Huffington Post: The Air Force says 34 nuclear missile launch officers have been implicated in a cheating scandal and have been stripped of their certification in what is believed to be the largest such breach of integrity in the nuclear force.
Some of the officers apparently texted to each other the answers to a monthly test on their knowledge of how to operate the missiles. Others may have known about it but did not report it.
The cheating was discovered during a drug investigation that involves 11 Air Force officers across six bases in the U.S. and England.

Taken alone, it would be easy to dismiss those stories as “coincidences”.  But when you put them together with the stories of dozens of other high ranking military officers that have been purged from the U.S. military in recent years, a very disturbing pattern emerges.

South Dakota Republican Party votes, calls for Obama's impeachment at state convention

RAPID CITY, South Dakota — The South Dakota Republican Party has passed a resolution at its state convention that calls for the impeachment of President Barack Obama.
The Argus Leader reports (http://argusne.ws/1svDDDc) the resolution says Obama has "violated his oath of office."

The resolution cites the release of five Taliban combatants in a trade for captive U.S. soldier Bowe Bergdahl and the president's statement that people could keep their health insurance companies. It also cites recent Environmental Protection Agency regulations on power plants.

It calls on the state's U.S. Representatives to start impeachment proceedings against the president.

Allen Unruh of Sioux Falls sponsored the resolution.
Delegate David Wheeler of Beadle County disagreed.
Wheeler said before the vote that the delegates would look petty if they passed it.
Delegates voted 191-176 in favor of the resolution.

       That statement begs the question: “Well where did the concept come from?”   It has to have a source, and that source is…

 The Principle of Natural Membership

   By that principle, animals and humans are, by birth, members of the group into which they are born.  They are natural members of their group.  They are natural children of their society. They are natural citizens of their nation.  They aren’t outsiders because they were not born to outsiders but to members.  Their membership is therefore natural membership.

The Constitution reserves one and only one office solely for a “natural born citizen” and that is the office of the President.  The use of the word “natural” actually means natural.  It does not have any reference to the location of one’s birth. Instead, it refers to the nationality of one’s father.   A “born citizen” is one with citizenship from birth.  A natural citizen is one with citizenship also from birth but, more importantly, citizenship by birth, -a citizen by being born as a natural member of the national group.
If one is a citizen by birth then one is not a citizen by law because law only relates to the citizenship of those who are foreigners and children born to them.  No other law regarding citizenship exists nor can legitimately exist because no authority is provided to Congress to legislate regarding the citizenship of natural members of our country.

The citizenship of natives of the American nation is beyond the authority of Congress to touch.  Also, since 1898, thanks to a Supreme Court opinion regarding the 14th Amendment, the same is true in regard to children of immigrants.

But even though the amendment is a much higher law than what the Congress can pass, it nevertheless is law, and is necessary in order for U.S. born children of immigrants to obtain citizenship.

Without it, (and a domestic birth) they have no U.S. citizenship because they have no natural right to membership in a group to which they inherit no membership from their outsider parents.  Thus, instead of being dual citizens, they would be citizens of only their father’s homeland.

The difference between natural citizenship and legal citizenship raises many questions.  But Mr. Barack Obama won’t and can’t answer them because the answers destroy any illusion that he is truly constitutionally qualified to be the President.  Obama knows full well that he is required to be a “natural born citizen” and he also knows full well that he is not that kind of citizen and the reason is very apparent.

But the minds of the American people aren’t as clear as that of the self-described “Kenyan-born” “constitutional scholar” Barry Obama.  So, in order to dispel ignorant and false certainty about the nature of his citizenship, a few well conceived questions for him are in order.
The questions are the following:

• Mr. Obama, if John McCain, born of American parents (on foreign soil), is (as declared by the U.S. Senate, -including yourself as a member) a natural born American, then what are you?
•  Mr. Community Organizer, if like John McCain, you also had been born in Panama, (to your American mother and foreign father), would the Senate have declared you to be a natural born American as it did on behalf of John McCain?
• Mr. Dunham, if you had been born in the United States, but your mother was the Kenyan wife of your father, would you not be a natural born Kenyan by the same principle of
  patrilineal descent that made John McCain a natural born American citizen?
• Mr. Soetoro, is it possible to be a natural citizen of more than one nation?  If one had parents who were dual citizens (with parentage in four different nations) would one nevertheless be a natural citizen of four different nations?  Or merely a statutory citizen?
• Mr. “Columbia graduate”, if you had been born in Kenya to American parents, would you not have been a natural American citizen just like John McCain?
• Mr. Constitutional Scholar, if one of the twin daughters of President George W. Bush had been born on the American side of that house situated directly on top of the U.S.-Canadian border, but her twin sister had been born across the room on the Canadian side, would that sister (though having a father and grandfather who served as U.S. Presidents) be ineligible to be President? Or would they both be eligible because they were Americans by birth?  And what principle do you think the authors of the presidential eligibility clause intended when they used the word “natural” in the term “natural born citizen”, -geographical location? or blood-connection natural inheritance?
• Mr. Commander-in-Chief, If the pregnant wife of George Armstrong Custer had accompanied him and the Seventh Cavalry to Sioux Territory, and delivered George Custer Jr. on the Sioux land, would his son be considered a natural native-born Sioux?  Would he be eligible to one day be the Chief of the Sioux nation?
• Mr. Citizen of Hawaii, if you were really born in a Hawaiian hospital, why does no hospital in Hawaii claim bragging rights to you?
• Mr. Unvetted Candidate, If one’s citizenship does not exist without the intervention of passed laws or an amendment to the Constitution, how exactly could such citizenship be considered natural when it’s wholly dependent on human law and not natural law?
• Mr. World Citizen, How is it possible for a citizen of one nation to father a natural citizen of a different (foreign) nation?
• Mr. Women’s Advocate, If you were born a century earlier, during the period of the Nationality Act of 1907 (by which your mother would have lost her U.S. citizenship by marrying a foreigner) -with your mother being a British citizen only, as well as yourself, how then could you be considered to be a natural American citizen today when the nature of natural citizenship hasn’t changed, and is not dependent on nor alterable by the convention of human law?
• Mr. Questionable Citizenship, Should someone who has avoided calling himself a natural born citizen be considered by others to be one ?
• Mr. “Native-Born Citizen”, If one is part and parcel of their parents, sharing their name, status, and nationality, then can one’s “native land”, somehow be a foreign country, -one other than their parents’ country?  Are they a “natural” member of a society which is foreign to their parents, or are they a natural member of only their parents’ society and nation?  Can they be a natural native member of a group/tribe/society/nation in which their parents are outsiders?
• Mr. “Kenyan born” “foreign student”, Can someone with dual nationality, dual allegiance, dual attachment to two nations be viewed as a natural member of either nation?
• Mr. Duly Elected President, Can someone born with two nationalities be regarded as a natural American citizen and therefore fully eligible to command all the federal bureaucracy and policing agencies, all the military power of the nation, even including at one point tens of thousands of nuclear bombs?  How can someone who could not qualify to guard the President with a loaded weapon because of dual-citizenship at birth, be considered to be eligible to be the President?  How can someone who couldn’t qualify to have access to American nuclear weapons be viewed as fully qualified to command the use of those weapons?
• Mr. U.S. Law Historian, Can someone be a natural American if they self-admittedly were born subject to the Nationality Act of a foreign nation even though the Civil Rights Act of 1866, expressly bars U.S. citizenship from those so born?
• Mr. Statutory Citizen, Can someone born of a foreign visitor, (-a guest of the government via a student visa), be an American citizen by the 14th Amendment when it expresslly requires such a child, through its father, to be fully subject to federal authority, (and not foreign authority) -the kind that can strip one of nearly all of their civil rights, throw them into military boot camp, force them to undergo torturous combat training, and then send them to their death in war, (an authority that no government on earth claims)?
• Mr. Mystery Citizen, Can one whose only claim to citizenship is through an administrative policy based on a perversion of a Supreme Court opinion, -a policy that’s demonstrably erroneous, be considered to be a natural born citizen even though natural citizens have no law, amendment,  judicial opinion, nor federal policy granting them their citizenship?
•  If one is born as a natural member of their parents’ nation, then how can they also be a natural member of a foreign nation in which, by happenstance, they were born, even though their parents have no connection to that nation and are mere guests?
• How can anyone be a native member of a country in which neither of their parents are members?  What powerful nuclear nation on Earth trusts a non-native or a half-native member of their society to control the full power of their military, and all departments of government, (including  nuclear weapons)?
• How does a teacher of the Constitution, one fathered by a foreigner, upon his first reading the of Constitution’s requirement for the presidency, (“No person, except a natural born citizen shall be eligible…” not know that he is excluded by it?
• Mr. President, By what warped, stretched, or convoluted logic are you even remotely qualified under the the Constitution to be President?
• How does any American, or any citizen of any modern nation, go through his entire adult life, through his young adult years, his college years, professional years, married years, political years, and not possess a birth certificate?  How is that not an impossibility?
• How can one be forced to request a copy of their birth certificate for the first time when they are in their forties and running for President?  It wasn’t lost in any fire, flood, or tornado, so where is it?
• Why would one not simply show the birth certificate that one has always possessed unless it contains something that would reveal one’s disqualification for office?
• If one were to realize that in the minds of the ignorant population, mere birth on U.S. soil would qualify them, then why would a determined office-seeker not do what determined teenage alcohol-seekers do and concoct a fake ID or birth certificate in order to obtain what they seek?
•   How does one who’s offered the chance to be President not accept the chance when everyone is willing to overlook the inconvenient truth about the little road-bump of the Constitution having something uncomfortable to say about his qualification?   [If no one else cares, why should he?  And why the heck should the Constitution matter anyhow?  Who made it the boss of us all?]

Answers? Answers?  -Not a one in sight

We would like answers, we are entitled to answers….but we’ll never get any answers because no one dares ask the questions.  Cowards on the left of us, ignoramuses on the right of us, hypocrites in front and in back of us.  Or is it that they aren’t merely cowards, but they know the truth and fear that it will split the nation in half like we haven’t seen since the Civil Rights era?  No doubt it’s both, -some silent out of ignorance, some silent out of fear, or plain old indifference. But they are not charged with the duty of remaining silent if ruled by fear.  They are charged by the Oath of Allegiance to the Constitution by which they were sworn into office to be faithful to it, and defend it against all enemies, both foreign and domestic.  Enemies are not simply those who are hostile to the United States.  Enemies are those who trample the Constitution underfoot (including the enemy that occupies the White House)  as well as those who silently permit it to happen and say and do nothing.

But he is the President.  Legitimately elected by a majority of the American people.  But illegitimately seated and validated by the cowards and ignoramuses of the U.S. Senate who failed in their constitutional duty to vet the qualification of everyone elected to serve as President & Vice- President.  Instead, they, and the Supreme Court, remained silent and complicit as the crime of the century against the presidency occurred.

But that crime is small potatoes compared to what occurred when the tyrannical Health Care legislation monstrosity was ruled by the court to be constitutional.  In relation to individual rights and fundamental freedom, that was the equivalent to having an arm amputated.   Everything rested on the outcome of the presidential election.  Now it can, and probably will, permanently alter the path America takes into the future because the SCOTUS traitors will probably allow it.
Will Americans tolerate the health insurance mandate being distorted by being labeled a tax instead of a penalty?  Apparently they have.

If the monstrous usurpation of State authority by the socialism-loving Progressives populating the federal government doesn’t inspire the kick-start of a new American revolution that succeeds at taking back the government that has been stolen by an oligarchy of interests aligned against the American character, economy, history, fiscal integrity, and foundational principles, then we will have gone past the tipping point, (-the likes of which we’ve never seen in our lifetimes)  through the looking glass and down the rabbit hole into a socialist future under a Queen of Hearts BIG GOVERNMENT in which “All ways are my ways”.

Free will and free choice will then be relegated to history.  We will have become the
United Socialist States of America, -unless some States rebel, as with the marijuana legalizations.

We the American citizenry seem to expect our political leaders to lie to us.  Barack Obama has come through in spades. More

Impeachment: Is it really impossible?

• A president using all the forces of the federal government to reward friends and destroy enemies;
• A president defying the Constitution and the Bill of Rights to advance his own interests;
• A president weakening our military, dismantling our national defenses, and putting America’s security in grave jeopardy;
• A president ignoring two centuries of immigration laws to drag as many illegal aliens as possible across our borders, keep them from assimilating, addict them to dependency and, ultimately, buy their loyalty at the polls;
• A president shielded from all accountability by both a supportive and parroting mainstream liberal media, and the power-hungry cabal of his own party in Congress who will do whatever it takes to win;
• A president whose behavior demands impeachment, but who doubles-down on destroying the fabric of America because he knows the GOP congressional leadership is too weak-willed to bring him to justice.

Sound familiar? Just like it came out of today’s headlines, right?
Now imagine if we could add one more sentence to this litany: A handful of patriots in Congress mapped out a successful plan to impeach the renegade president, brought him to the bar of constitutional justice, and ended the tyrannical assault upon our cherished Constitution.
“Forget it,” you say. “It can’t or won’t happen.”
You’re half-right. It can happen – and it already has. But it won’t happen unless every concerned American who craves the freedom begat to us by the Founders reads the blueprint for battle.
How do we know the blueprint works? Because it already has.

GETTYSBURG – the name alone stirs memories or thoughts maybe even feelings difficult to describe but very real to the soul.  Gettysburg…a land known for one of the bloodiest battles of the Civil War, a land where so many hearts were broken, so very many more stopped altogether!  Gettysburg is a pivotal place in our country’s history, where a pivotal battle raged for three very long and hot days in July at this farm in Pennsylvania.  The battle was a turning point in the Civil War, a battle that actually helped to bring an end to the very sobering and terribly destructive “contest between the states.”  Today, Gettysburg remains hollowed but with tears clearly present for those who wish to see; yes, crying…for healing and reconciliation between whites and blacks, between whites and whites, and blacks and blacks.  Healing and reconciliation the kind no bullets can produce, no army can march upon, no power or force can forge by sheer will or might.  Only through the prayers and words of forgiveness can Godly people pour God’s healing balm upon hearts still sorely wounded.

I have been writing about this time for, at least,  the last ten years.  It has now arrived.  It has occurred under Barack Hussein Obama. Those who say “Obama has now lost his political power” are either not seeing what’s going on or are willfully attempting ignorance.  As predicted, Obama’s power as dictator-in-chief is on the rise and growing exponentially every day.

Obama and his criminal syndicate are completely and tyrannically running the show in the USA.  US and Constitutional laws are not being followed—and have not been since Obama took the Office of POTUS—by Obama and the members of his ruling cabal.  Obama’s legal authority is to enforce the laws of the land.  Obama has—and is—doing neither.  Instead, he is writing and judging laws—replacing both Congress and SCOTUS.

The Obama syndicate didn’t like SCOTUS’ Citizens United decision regarding political contributions from all—not just its own leftist supporters.  Therefore, the ObamaGov sicced its now-whollyowned IRS on Obama’s enemies conservative, Christian and observant Jewish organizations in order to keep them all from being politically active in opposing his Orwellian and subversive policies.  In an article from Huff Post—hardly a conservative or even “moderate” publication—Harlow Giles Unger writes:  “Nothing in the Constitution gives a president power to issue executive orders or proclamations with the force of law. The opening words of Article I of the Constitution are quite clear: “All legislative powers… shall be vested in a Congress of the United States.”

We Don't Need No Stinkin' Emails

They're openly sneering at us now. Late on Friday, the Internal Revenue Service revealed that two-and-a-quarter years of Lois Lerner's emails have been "lost". Yesterday the IRS told Congress that it is unable to produce the emails of six other officials involved in the targeting of conservative groups, among them Nicole Flax, the chief of staff to then IRS commissioner Steven Miller.

We now learn that the IRS only retains email on its server for six months. After that, the email exists only on the hard drive of the physical desktop computer of the employee in question. And therefore, if that hard drive crashes, those emails are lost forever.

By the way, do feel free to try that excuse if the IRS asks you to produce any document more than six months old. As I said way back when at the dawn of this investigation, everyone subject to the attentions of this agency should play by Lois Lerner Rules: oh, it'll take me years to produce all that stuff - even if I still have any of it.

Is it just the seven officials in whom Congress is interested whose computers crashed so catastrophically? That would seem statistically improbable. Or is this a more widespread problem and there are hundreds, thousands of IRS employees who've lost years of their emails? And, if that's the case, why has nobody suggested that that policy of only retaining emails on the server for six months needs to be changed, urgently? After all, the IRS isn't shy about telling the citizenry that their own data-retention policies are insufficient. Indeed, Cleta Mitchell (the lawyer representing certain of the targeted groups) says that one of her clients was penalized by the IRS for only retaining emails for a year - ie, twice as long as the IRS server retains them.

The evidence of a growing anti-Christian sentiment among Washington’s top echelons is overwhelming. Obama and Hillary surrounded themselves with Muslim “advisors.” Bill waged war with American blood and treasure in Serbia that led to the creation of a Muslim state, Kosovo, from the Christian Serbia. Indigenous Assyrian Christians started leaving Iraq almost immediately after we “won” the war there. Most now live in Malmö, Sweden. Has the definition of the word “win” changed?

First Lady Michelle Obama reminded attendees of a naturalization ceremony Wednesday that the Founding Fathers weren’t born in America [JUST LIKE HER HUSBAND]

The ceremony for 50 new U.S. citizens was held at the National Archives in Washington, D.C.
“It’s amazing that just a few feet from here where I’m standing are the signatures of the 56 Founders who put their names on a Declaration that changed the course of history,” she said during her speech, referring to the Declaration of Independence. “And like the 50 of you, none of them were born American – they became American.”
Obama pointed out that the Founding Fathers pledged their lives and risked everything to create the United States of America after signing the Declaration of Independence.
“Just like you’re about to pledge allegiance to our flag, they pledged their lives, their fortunes, and their sacred honor to this extraordinary idea that we now know as America – the notion that we are all created equal, endowed with fundamental rights and freedoms that no one can ever take away from us,” she said.
The First Lady explained that the Founding Fathers were “Americans-by-choice” just like the newly declared citizens.
“As the newest 'Americans-by-choice,' you, too, will play an important part in shaping our history,” she continued.
Immigrants, she explained, were essential to the continued growth of the United States.
“I know this is an exciting, hopeful time for all of you, but it’s also an exciting, hopeful time for our country,” she said. “Because the fact is, America needs you.”
Obama also reminded the new citizens of their importance to the historic character that immigrants brought to the country.
“Immigration is at the heart of how we developed as a nation,” she said. “In every generation, immigrants have earned their place as part of 'We the People.'”

“I will say, the first lady’s kind of a bad example because the first lady doesn’t get paid. And she works pretty hard,” the president said at a roundtable discussion on manufacturing in Pittsburgh.
The quip came at the end of an extended discussion about how family-friendly policies were good for business. The White House has championed equal pay legislation that would provide additional protections for female workers, but the bill stalled in Congress earlier this year.

As in Watergate, this fish rots from the head. The entire Obama administration is in contempt of Congress, the American people, the law and the Constitution. As in Watergate, more than a few individuals warrant prosecution and incarceration. But that would have to come from Eric Holder's Justice Department, an organization shown to be as corrupt as the IRS.

We are reminded how, during his Arizona State University commencement speech in 2009, President Obama noted that ASU had refused to grant him an honorary degree and "joked" that "President (Michael) Crowe and the Board of Regents will soon learn all about being audited by the IRS."
The joke was not funny then and is less funny now. It was a predictor of administration behavior. Lerner's knowledge of and participation in planning to use the IRS as a political weapon, in coordination with the White House, is why she twice invoked the Fifth Amendment in her congressional visits, even as she was cooperating — or is it coordinating? — with Eric Holder's Justice Department.
As Joseph Curl notes in the Washington Times, the Articles of Impeachment against Nixon charged that he "endeavored to obtain from the Internal Revenue Service, in violation of the constitutional rights of citizens, confidential information contained in income tax returns for purposes not authorized by law, and to cause, in violation of the constitutional rights of citizens, income tax audits or other income tax investigation to be initiated or conducted in a discriminatory manner."
