Dear Mr. Burling:

This letter is in response to your letter dated October 3, 2012 in which you claim there exists no probable cause on which to base an investigation of my allegations that Barack Obama is in violation of ORC Sec. 2913.49, pertaining to Identity Fraud. The following reasons, which you reviewed in both my Complaint and Affidavit, demand that such an investigation be conducted by your office. Not to do so violates your oath of office and ORC Sec. 2921.44(A)(2), Dereliction of Duty and 2921.32(A)(6), Obstruction of Justice for the following reasons:

* Barack Obama has used a social security number, 042-68-4425, exclusively reserved for residents of Connecticut and has done so consistently for the past twenty-five years. It is no more credible that he would have a Connecticut mailing address than that he was a Connecticut resident;

* When his use of that number was verified, the year 1890 also appeared as Barack Obama's date of birth;

* On address searches for his residence and employment, the CT number appeared along with his date of birth as August 4, 1961 and, randomly, as 1890;

* The number he uses was assigned on March 28, 1977, when Barack Obama was fifteen years old and a student in and resident of Hawaii;

* Social security numbers bracketing his number from 042-68-4415 to 4435 all were issued in Connecticut in 1977, as were all numbers beginning with 042 until the government began issuing them randomly on June 25, 2011;

* Numbers were assigned by the zip code of the mailing address shown on the application (attached);

* Barack Obama never lived in Connecticut and verified in his book, Dreams from My Father," that he was a resident of Hawaii from 1971 to 1979;

* Social security numbers are never reissued by the Social Security Administration (SSA)

* Barack Obama has fraudulently obtained, used and continues to use unlawfully a social security number which misleads the public and, per se, government officials;

* Barack Obama, under oath, swore on Illinois law license registration that he never used any other names; however, he was enrolled in school as a child in Indonesia as "Barry Soetoro;"

* The improper social security number appeared on his Massachusetts driver's license, his Internal Revenue filing and Selective Service Verification;

* Barack Obama has violated and continues to violate ORC Sec. 2913.49, Ohio's Identity Fraud statute.

Attached is the cover page and a page from the "Social Security Number Fraud Investigative Guide, Second Edition (October 1989) from the Department of Health and Human Services. On page 37: "The first 3 digits of an SSN indicate the State or geographic area in which the number was issued. The remaining 6 digits have no geographic significance. Before 1973, SSNs were not assigned by the SAA district offices, and a person's SSN did not establish that he/she was a resident of the State to which the first 3 digits were assigned. It merely established that the card was issued by an SSA office in that State. The SSA now issues from its headquarters in Baltimore, Maryland. The first 3 digits of a person's SSN are determined by the ZIP code of the mailing address shown on the application for an SSN. (Emphasis added.)

Also, From the SSA Publication No, 05-10002 (dated May 8, 1999) as follows:

What The Digits Mean (page two)
The nine-digit number is divided into three parts. The first three digits indicate the state shown in the mailing address on the original application. (Emphasis added.)

When Someone Misuses Your Social Security Number (page three) It is against the law to use someone else's Social Security number or to give false information when applying for a number. Also, it is illegal to alter, buy, or sell Social Security cards. Anyone convicted of these crimes is subject to fines and/or imprisonment. (Emphasis added.)

Nowhere in the Identity Fraud statute is a requirement to prove "beyond a reasonable doubt" that Barack Obama is improperly using a social security number.

The name of the previous owner of the number is irrelevant. The core of the matter is that Barack Obama is using a social security number that has not cannot have properly been issued to him and that he has, therefore, been fraudulently representing his identity.

Additionally, there is no invasion of privacy to anyone. The social security number which Barack Obama has been using, and which is associated with his name, has been on the internet for three years.

An investigation by your office would consist of sending a letter to the Social Security Administration and requesting a copy of the original application for the number that Barack Obama uses, 042-68-4425, and any other documents in that file.

For all the reasons listed, Geauga County law enforcement officials, under the sworn oath of office to enforce the Constitution, are required to investigate the allegations of a crime.
