And to those like Leo Donofrio (whom I greatly admire for more than “slam dunk” establishing that “natural born citizen” requires both citizen parents) I would respectfully dissent from Leo’s opinion that Judge Carter (at pp 43-44 of Oct 5 transcripts) tips his hand against Orly. To the contrary, Judge Carter is saying geography is not important where parents are citizens, hence, McCain (per Judge Carter at least) IS POTUS eligible, as distinguished from Obama where “natural born citizen” definition (two citizen parents; no dual loyalty) TRUMPS geography.

It seems the handwriting could be (we hope) on the wall as Judge Carter has found a way to (1) keep jurisdiction without quo warranto simply on a tortuous fraud case by Keyes for damages, (2) avoid the constitutional crisis of ousting Obama (Congress will do that after Obama is found to have civilly defrauded Keyes, maybe with or without RICO or conspiracy), and (3) with no need to address the McCain-Panama issue.

The Commubamaists point out " McCain was born in Colon,Panama in a hospital outside the U.S. Canal Zone."

McCain's parents were in Panama on military assignment. Vattel thought of these infants who were "born of the Armies of a nation". McCain's father was of the "Armies" of the US doing our country's bidding as ordered in Panama.

Justice Carter asked Orly what if McCain was born in a jet over the Atlantic. To me I would have answered with "Was it a military trip, family in transit or a vacation get away aboard a non US flagged air carrier?" The first answer would qualify him as NBC and eligible, the second an ordinary US citizen, not NBC and not eligible to be POTUS.
