Upon Further Review...... Article 5 Constitutional Amendment Convention To Repeal ObamaCare Is Doable NOW.

Yesterday I wrote an article about where we stand on a possible state led Article 5 amending of the constitution to repeal ObamaCare. Just like in the NFL the refs sometimes have to do some more cypherin' to arrive at the best answer, sometimes I do too. I'm not changing my call, I'm actually going further in that direction.

If you haven't read my article (and why not???) regarding an Article 5 repeal, I've included it directly below. I wouldn't want any of you to strain yourselves looking.

We have the horses right now to repeal Obamacare. The states could call for a convention and get the 38 votes needed to amend the constitution. Here's why I say this:

Tennessee, New Jersey, and New Mexico have yet to heard from either where they stand on nullification or in joining a lawsuit against ObamaCare. All three have newly elected republican governors.

Right now there are 32 states actively working against this law. 26 are headed by republican governors and 6 are headed by democrat governors. If you add New Mexico,New Jersey and Tennessee we are now up to 35. Enough to convene, but still 3 short for ratification.

Here they are - North Carolina, Kentucky, and Arkansas.

These 3 states have democrat governors currently. In the 2010 election North Carolina and Arkansas trended republican with the election of Boozman and re-election of Burr. Kentucky's 2 US senators are republicans Rand Paul (2010), and Mitch McConell. The governor's house in Kentucky is up for grabs in 2011, North Carolina's in 2012 and Arkansas in 2014.

These three deep south states would also fall in line with every state south of the Mason Dixon line which are against ObamaCare. Tea Party country.

There could be other states too. Massachusetts has seen first hand what a travesty government run healthcare is, and then there is West Virginia and Rhode Island. Rhode Island is experiencing budget shortfalls related to providing healthcare for illegals, and a bipartisan effort is already underway to legislate a fix. West Virgina should be about ready to throw off Joe Manchin and his ObamaCare Sniper Ad.
Manchin hit the target with his 30-06 during the 2010 campaign but was completely off target when a senate repeal vote was held a week or so ago. The people of West Virginia were watching and may have some buyers remorse about now.

Perhaps these last few states are on an ObamaCare death watch, waiting to see if the courts throw it out, instead of jumping the gun with a convention, but when Obama smirks about his veto remember there are 38+ states ready to wipe that smirk off his face and have the final say on this illegal law.

Obamacare is having a harder and harder time of it. I'd venture to say Obama's crown jewel is on life support.

If you combine the states who have filed lawsuits against Obamacare and the states who are opting for nullification, the number now stands at 32 states. In order to convene a gathering to amend the constitution, 34 states must agree to hold such a meeting. It would take 38 states to ratify or approve the final product which would then become an amendment to the constitution. Once an amendment is made, the executive branch loses any veto power, and the Supreme Court cannot rule against it.

Article 5 of the constitution is the states' checkmate power over the federal government, thank you founders.

Here are the states either in suit or for nullification:

Of the 12 nullification states 9 are already party to a suit. The (*) indicates states which are for nullification only of Obamacare and not part of any suits at this time.

More than 3/5ths of the states are moving to end Obamacare, which highlights the deceit of the Obama regime. On the world stage Obama calls for the Egyptian government to heed the will of the people, yet right here in America the will of 64% of the States representing it's resident citizens are rebuffed by this hypocrite despot named Obama who usurps the presidency this very moment.
